警開單告知不清 酒駕免罰

聯結車司機吳新古酒駕被逮拒絕酒測，收到「駕照被吊銷，3年不得考照」罰單後，指控警察沒講清楚，提起行政訴訟。法官查出，警員果真沒講清楚，取締時是告知吳某「吊銷駕照3年」，而不是「吊銷駕照，3年內不得考照」，因此判吳某駕照不用被吊銷。

法官指出，警察在剝奪人民權利義務時，一定要清楚告知人民違法後的法律效果，取締警員未清楚告知，取締過程明顯有瑕疵，警員有再教育必要。

駕照不用被吊銷

判決指出，聯結車駕駛吳新古4月間酒後駕駛小貨車，途經基隆市麥金路、安和二街口被警方攔下，酒測值超過每公升0.55毫克，警方向吳某告知：「若拒絕酒測將罰鍰9萬元，並吊銷駕駛執照3年。」

吳主張，他當時盤算拒絕酒測，僅吊銷小客車駕照，又可免刑責，遂拒絕酒測，不料收到罰單才知，他的所有駕照都被吊銷，家庭生計頓失依靠，警察沒清楚告知拒絕酒測後的法律效果，使得他判斷錯誤。

法院經過勘驗光碟發現，取締警員對吳某告知的內容確有錯誤，與取締酒後駕車作業程序規定要講的「拒絕酒測將罰鍰9萬元，並吊銷駕照，3年內不得再考領」出入甚大，判決撤銷「吊銷駕照，3年內不得再領考」這項處分。
