未成年網購 家長不同意可退費

新北市1名國二少女瞞著家長上網購買3200元的包包，家長要求業者退貨退款；新北市政府消保官周繼雄表示，依民法規定，7歲以上、未滿20歲屬「限制行為能力」，購買「非生活必需品」沒有獲得法定代理人同意，代理人有權要求解約，業者應無條件退款。

周繼雄表示，依民法第13條、第79條規定，7歲以下是「無行為能力」，7歲到20歲是「限制行為能力」，這兩個年齡層購買任何物品，應徵得法定代理人的允許。

這件國二少女瞞著父母網購3200元包包，父母在7天內的鑑賞期要求業者退貨退款，因網路賣家地址登載不實，這件消費爭議案不了了之。（記者李信宏）
